The rules, limitations, and business terms that apply when a user accesses or uses PPS.

1. Acceptance of these Terms
These Terms of Service ("Terms") form a legal agreement between you and Quinn Wilson regarding your access to and use of PPS, including the website, vault content, embedded media, prompts, materials, downloads, and related services.
By accessing, purchasing, registering for, logging into, or using PPS, you agree to these Terms and our Privacy Policy. If you do not agree, do not use PPS.

2. Eligibility, account access, and account security
PPS is intended for users who are legally able to enter into a binding agreement in their jurisdiction and who are at least the age of majority where they live.
You are responsible for keeping your login credentials confidential and for activity that occurs through your account. You must provide accurate information, use an approved email address where required, and notify PPS promptly if you suspect unauthorized access.
- Whitelist approval may be required before registration or access is allowed
- Access may be suspended or revoked for security reasons, non-payment, fraud concerns, breach of these Terms, or misuse of the product
- Unless otherwise stated in writing, PPS access is for the approved user only and may not be shared, sublicensed, resold, or redistributed

3. What PPS is and is not
PPS is a login-protected digital educational product. It teaches users how to use their own AI tools as nutrition and behavior-support tools.
PPS is not medical care, dietetics services, diagnosis, treatment, psychotherapy, emergency support, individualized clinical advice, or a meal-tracking backend. PPS does not replace a physician, dietitian, therapist, psychologist, psychiatrist, emergency service, or other qualified professional.

4. Educational use only
All PPS content is provided for educational and informational purposes only. It is designed to help users think more clearly, prompt AI tools more effectively, and build personal systems for decision support.
PPS content is general in nature. It may not fit your personal medical history, allergies, medications, injuries, eating-disorder history, mental-health status, pregnancy, breastfeeding status, or other circumstances. You are responsible for deciding whether and how to use PPS content in your own life.

5. No professional relationship and no client relationship
Your use of PPS does not create a doctor-patient, dietitian-client, therapist-client, psychologist-patient, counsellor-client, fiduciary, advisory, or other professional relationship between you and PPS, its owner, contributors, contractors, or affiliates.
Any support or product communications are customer-service communications only. They do not create a professional services relationship, clinical duty, supervision duty, crisis-support duty, or individualized care obligation.

6. AI tools and third-party services
PPS may refer you to or be used with third-party services such as ChatGPT, Claude, Gemini, Copilot, Firebase, Stripe, Beacons.ai, Make.com, Hostinger, or YouTube. Those services are independent third parties with their own terms, privacy policies, security practices, availability, and pricing.
PPS does not control third-party AI outputs, model changes, outages, training practices, moderation decisions, or provider policies. You are responsible for reviewing and complying with third-party terms and for deciding what information you share with those providers.

7. User responsibilities and prohibited uses
You agree to use PPS lawfully, responsibly, and only for its intended educational purpose. You agree not to use PPS in a way that is unsafe, misleading, abusive, unlawful, or likely to cause harm to yourself or others.
- Do not treat PPS as medical, dietetic, psychiatric, therapeutic, or emergency advice
- Do not rely on PPS or third-party AI output alone for urgent, high-risk, or clinically significant decisions
- Do not use PPS to provide clinical, professional, or regulated advice to other people unless you are independently qualified and responsible for that use
- Do not upload or submit information you do not have the right to share
- Do not attempt to reverse engineer, scrape, republish, copy at scale, resell, or commercially exploit PPS content except as expressly permitted in writing

8. Payments, access, and refunds
Prices for PPS may change at any time before purchase. Unless otherwise required by applicable law, the price shown at the time of checkout is the price that applies to that transaction. PPS is not required to provide retroactive discounts, credits, or price matching for earlier or later offers, promotions, or pricing changes.
Payments may be processed through third-party providers such as Stripe and checkout tools such as Beacons.ai, depending on the configured sales flow. Payment information is processed by those third-party processors under their own terms and privacy policies, not directly by PPS except to the limited extent PPS receives transaction-status or fulfillment information needed to operate the service.
After a successful purchase, access may be granted through a whitelist-based account-access process. Access may be provided immediately, delayed briefly for automated fulfillment, or delayed for manual review if needed. Expected access timing: Access is typically granted within minutes after purchase..
If a payment fails, is declined, is flagged for review, or is not completed, PPS may withhold access until the payment issue is resolved. If a purchase succeeds but access is not granted because of a fulfillment problem, whitelist issue, or technical error, PPS may investigate, retry fulfillment, request additional verification, or provide another reasonable access remedy consistent with applicable law and the refund policy.

Any approved refund will generally be sent back to the original payment method, subject to the rules and technical limits of the payment processor. Refund timing is controlled in part by the processor and the customer's financial institution, and may take additional business days to appear after a refund is issued.
If a payment is disputed, charged back, reversed, or reported as potentially fraudulent, PPS may suspend or revoke access while the matter is reviewed. PPS may also deny, delay, suspend, or permanently revoke access where fraud, abuse, payment misuse, account sharing, chargeback abuse, or other misuse is reasonably suspected.

9. Access Duration and Lifetime Access
"Lifetime Access" means access for the commercially reasonable lifetime of the Precision Plate System (PPS) product, as determined by the company in its sole discretion. It does not guarantee access for the lifetime of the purchaser. The company reserves the right to modify, suspend, replace, or discontinue the product, platform, features, or access at any time, with or without notice, without liability.
This section should be read together with the access, suspension, termination, and product-change sections of these Terms.

10. Product evolution and versioning
The Precision Plate System may evolve over time, including updates, redesigns, rebuilds, replatforming, changes in structure, or new versions.
Access to the current version of PPS does not guarantee access to every future version, feature set, delivery platform, integration, or release format. The company may change how PPS is organized, delivered, maintained, or accessed over time.
At its sole discretion, the company may offer upgrades, replacements, migrations, successor products, or alternative access arrangements, but it is not required to provide identical access to all future versions or platforms.

11. Results, testimonials, and no guarantees
Results from PPS vary from person to person. PPS is an educational product, not an outcome guarantee, and it does not promise that any user will achieve weight loss, body-composition change, improved adherence, behavior change, better health markers, symptom improvement, financial benefit, or any other personal result.
Any examples, case studies, testimonials, success stories, sample scenarios, or before-and-after narratives are illustrative only. They are provided to show how PPS may be used or how some users may describe their experience. They are not promises, warranties, or assurances that you will achieve the same, similar, or any result.
Outcomes depend on many factors outside PPS's control, including your starting point, health status, medical history, medications, consistency, food environment, stress, sleep, budget, preferences, access to care, accuracy of information provided to AI tools, quality of third-party AI outputs, and how you apply or do not apply the material.
PPS does not make performance claims about what will happen if you buy, read, or use the product. Any statement that a user can improve results, reduce confusion, or build a better decision system should be understood as a description of the product's educational purpose, not a guarantee of any specific outcome.

12. Disclaimer of warranties
To the maximum extent permitted by applicable law, and subject to any non-waivable consumer rights that may apply, PPS is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, Quinn Wilson disclaims all warranties, representations, conditions, and guarantees of any kind, whether express, implied, statutory, or collateral, including any implied warranties or conditions of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, or uninterrupted access.
PPS does not warrant that the service, content, prompts, videos, links, downloads, or third-party integrations will always be available, error-free, secure, current, complete, suitable for your circumstances, or free from interruption, delay, defect, or incompatibility.

13. Use at your own risk
Using PPS may involve decisions about food, body weight, exercise, habit change, behavior, motivation, and interaction with third-party AI tools. These areas carry real-world risks, including misunderstanding information, using poor judgment, following incorrect AI output, over-restricting intake, making unsuitable exercise choices, or worsening an existing condition.
By using PPS, you agree that you are choosing to use the product at your own risk. You are responsible for deciding whether PPS is appropriate for you, when to stop using it, and when qualified professional advice is needed.

14. No responsibility for third-party services
PPS may rely on or interact with third-party services, platforms, processors, hosting providers, automation tools, embedded media providers, and AI systems. Those services are independent from PPS and operate under their own terms, policies, security practices, technical limits, and business decisions.
To the maximum extent permitted by law, Quinn Wilson is not responsible for third-party outages, errors, hallucinations, downtime, security incidents, account restrictions, moderation decisions, feature removals, pricing changes, API changes, policy changes, checkout failures, hosting issues, or other acts or omissions of third parties.

15. No responsibility for user health outcomes, food choices, exercise choices, or reliance on AI outputs
To the maximum extent permitted by law, Quinn Wilson is not responsible for your health outcomes, weight outcomes, food choices, dietary restrictions, restaurant orders, exercise choices, supplementation choices, medication-related decisions, mental-health decisions, or the consequences of relying on PPS content or third-party AI outputs.
This includes situations where a user relies on calorie estimates, macro estimates, meal suggestions, restaurant suggestions, behavioral prompts, or other outputs that later prove inaccurate, incomplete, unsuitable, or unsafe. You remain solely responsible for your decisions and actions.

16. Limitation of liability
To the maximum extent permitted by applicable law, Quinn Wilson and its owner, officers, directors, employees, contractors, affiliates, licensors, and service providers will not be liable for any claim, loss, cost, damage, or expense arising out of or related to PPS except to the limited extent that such liability cannot lawfully be excluded.
This limitation applies whether a claim is based on contract, tort, negligence, statutory duty, misrepresentation, restitution, equity, or any other legal theory, even if a remedy fails of its essential purpose or PPS was advised that harm was possible.

17. Exclusion of indirect, incidental, consequential, special, exemplary, and punitive damages
To the maximum extent permitted by law, Quinn Wilson will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages arising out of or related to PPS.
This exclusion includes, without limitation, damages for loss of data, loss of access, account interruption, service downtime, third-party AI errors, incorrect outputs, business interruption, reputational harm, lost profits, lost savings, personal injury, emotional distress, health-related consequences, or decisions made in reliance on PPS content or third-party AI outputs.

18. Cap on liability
If liability cannot be fully excluded, then to the maximum extent permitted by law the total aggregate liability of Quinn Wilson for all claims arising out of or related to PPS will not exceed the greater of fees paid in the prior 12 months or CAD $100.

19. Indemnification by user
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Quinn Wilson and its owner, officers, directors, employees, contractors, affiliates, licensors, and service providers from and against claims, liabilities, losses, damages, judgments, awards, penalties, fines, costs, and expenses, including reasonable legal fees, arising out of or related to your use of PPS, your misuse of third-party AI tools, your violation of these Terms, your unlawful conduct, your content or submissions, or your infringement of another person's rights.
This includes claims arising from the way you use PPS, the way you interpret or apply AI-generated outputs, the information you submit to third-party tools, or the way you provide advice, instructions, or materials to other people using or based on PPS.

20. Suspension, termination, and product changes
PPS may change, update, remove, or discontinue content, features, access methods, vendors, or parts of the product at any time. PPS may also suspend or terminate access where necessary for security, business, legal, payment, or policy reasons.
Termination or suspension does not waive any rights or remedies that accrued before termination.

21. Governing law and disputes
These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles, and subject to any mandatory consumer protection laws that apply.
Unless applicable law requires otherwise, you and Quinn Wilson agree to submit disputes arising out of or relating to PPS or these Terms to the courts located in Ontario, Canada.
